ORDER

The petitioner herein, who was arrested and remanded to judicial custody on 14.10.2025 for the offences punishable under Sections 4(1)(C) and 5(A) of TNP (Amendment) Act and Section 77 of Juvenile Justice Act in Crime No.432 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that on 14.10.2025, while the respondent police were on their routine patrol duty, they found that the petitioner and other accused were involved in illegal selling of 36 nos. of IMFL liquor at about 11:00 hours against the Liquor Rules at near TASMAC No.2272, Karumathampatti, Coimbatore. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 14.10.2025; that the petitioner is working as a supplier of the said TASMAC Bar; and that the petitioner is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution case and submitted that there are totally three accused involved in this case and the petitioner is arrayed as A1; that the petitioner has three previous cases of similar nature; and that the investigation of the case is pending.

Considering the submissions made on both sides, nature of allegation, the previous antecedents of the petitioner and taking note of the fact that the investigation of this case is pending, this Court is not inclined to grant bail to the petitioner.

Accordingly, this criminal original petition stands dismissed. 31.10.2025 stn 3/4
