Habeas Corpus Petition filed under Article 226 of the Constitution of India to issue a Writ of Habeas Corpus directing the first and second respondents to produce the petitioner's wife by name Chinna Ponnu, wife of Govindaraj, aged about 37 years, before this Court from the illegal custody of third respondent and set her at liberty.

ORDER

(Made by N.Sathish Kumar, J.) This habeas corpus petition has been filed seeking to direct the first and second respondents to produce the petitioner's wife viz. Chinna Ponnu, wife of Govindaraj, aged about 37 years, before this Court from the illegal

custody of third respondent and set her at liberty. 2.

According to the petitioner, his wife viz. Chinna Ponnu, aged about 37 years, went missing from 25.07.2025 and that she is in the illegal custody of the third respondent herein; though he has given a complaint on 22.08.2025, the police are not taking effective steps to secure her. 3.

On instructions, the learned Additional Public Prosecutor would submit that on a complaint filed by the petitioner a case in Crime No.476 of 2025 has been registered for "woman missing" and during the course of investigation, it came to light that the petitioner's wife has eloped with one Manikandan, third respondent herein and investigation is in progress.

In such view of the matter, the police shall continue with the investigation and secure the detenue. As and when the detenue Chinna Ponnu, aged about 37 years, is secured, she shall be produced before the

Magistrate Court, concerned, under intimation to the petitioner. On such production, the learned Magistrate shall pass appropriate orders with regard to custody in accordance with law.

With the above observation and direction, this habeas corpus petition stands closed.
