Writ Petition (Criminal) filed under Article 226 of the Constitution of India to direct the 4th and 5th respondents to provide necessary police protection to the Petitioner Wakf and its management committee for discharging their lawful duties in respect of the Nawab Abdul Nabi Khan Masjid Wakf, situated at Lal Khan Street, Chidambaram, Cuddalore District - 608 001, without obstruction or interference from the 6th and 7th respondents or any persons set up through them. ORDER
This writ petition (criminal) has been filed seeking to direct the 4th and 5th respondents to provide necessary police protection to the Petitioner Wakf and its management committee for discharging their lawful duties in respect of the Nawab Abdul Nabi Khan Masjid Wakf, situated at Lal Khan Street, Chidambaram, Cuddalore District, without any obstruction or interference from the 6th and 7th respondents or any persons set up through them.

When the matter was taken up for hearing, it was brought to the notice of this Court that the Tamil Nadu Waqf Board appointed the deponent herein as the Hereditary Muthavalli, constituting a seven member management committee for the period from 17.04.2025 to 16.04.2028 of the petitioner wakf, and the same was communicated to the petitioner on 22.05.2025, based on which, the present writ petition came to be filed and this Court, vide order dated 10.11.2025 directed the respondent police to give interim protection to the petitioner and further directed the respondent police to take action against the 6th and 7th respondents, if they are found to be interfering with the petitioner's affairs illegally. However, it is pertinent 3/6
to note that the 6th respondent herein filed a writ petition before this Court in W.P.No.44468 of 2025, challenging the appointment of the deponent herein and this Court, vide order dated 17.11.2025, granted stay of operation of the said appointment order. Hence, the 6th respondent is continuing with the affairs of the petitioner wakf.
3. In view of the above, the learned Additional Public Prosecutor appearing for the 4th and 5th respondents submitted that subject to the outcome of the writ petition filed by the 6th respondent in W.P.No.44468 of 2025, necessary protection will be given to the succeeding party.
4. Recording the above submission made by the learned Additional Public Prosecutor, this writ petition (criminal) stands closed. No costs. Consequently, the connected miscellaneous petition is closed. 19.11.2025 skt Index : Yes/No Speaking Order : Yes/No NCC : Yes/No 4/6
