ORDER
This writ petition has been filed seeking issuance of a writ of mandamus directing second respondent to act upon the representation of the petitioner dated 02.08.2025 wherein the petitioner is seeking for cancellation of patta issued in favour of the private respondents based on an alleged fabricated document.
2. Heard Mr.L.Ramanathan, learned counsel for petitioner and Mr.S.Rajesh, learned Government Advocate appearing for respondents 1 and 2.
3. The case of the petitioner is that the property was originally owned by petitioner's grandmother and her elder brother. Patta also stood 2/4
in their name. However, the property was dealt with by third parties without any right or title over the property. Based on the same, patta was also issued their names. Hence, the petitioner submitted a representation on 02.08.2025 seeking cancellation of patta issued in favour of private respondents.
4. In the considered view of this Court, the sale deed has been registered in the year 2011 i.e. on 17.02.2011 registered as document No.575/2011. It is subsequent to execution of sale deed, mutation of revenue records has taken place and sub-division of patta has been made. The petitioner, without challenging the sale deed, cannot seek cancellation of patta, which has been issued acting upon the sale deed. Hence, no useful purpose will be served in directing the respondents 1 and 2 to deal with the representation made by the petitioner. It is left open to the petitioner to first question the sale deed before the competent civil Court, if so advised. Except giving this clarification, no further orders can be passed in this writ petition.
