ORDER

Thiru.K.Veera Raghava Rao, I.A.S., Principal Secretary, Department Of Labour And Employment and Dr.C.Palani, Director, Department of Employment and Training were present in court.

2. This court, by order dated 14.02.2025 in W.P.No.1771 of 2024, has directed as under:- "7. The learned counsel for the petitioner then contended that others, who had been similarly terminated along with the petitioner in AGROFED and who had also been retrenched were, however posted to a higher post in the Departments to which they have been appointed.

8. But the petitioner cannot claim equivalence with those individuals. The petitioner can claim equivalence only with his co-employees in the Department of Employment and Training and if he is eligible to be promoted, he will have to await and follow the rules and guidelines of the said department.

9. The writ petition is disposed of with a direction to promote the petitioner in accordance with rules and guidelines of the respondents. No costs."

It has been made very clear that the petitioner cannot claim equivalence with the individuals terminated alongwith the petitioners in AGROFED and who had been retrenched, however posted to a higher post in the Departments, where they had been appointed. It had also been made very clear that he can claim equivalence only with his co-employees in the Department of Employment and Training. A caveat had also been placed that if he is eligible to the promoted, he will have to await and follow the rules and guidelines and in accordance with the seniority.

It is also to be noted that the issue relating to the petitioner and others were dealt with in W.P.(MD) No.7241, 7359, 7105, 4023 and 7815 of 2010 and the learned Single Judge, by order dated 27.11.2024, had issued issued certain directions, which the petitioner takes advantage. Consequently, G.O.Ms.No.116 Labour and Employment (P2) Department dated 06.08.2015 had also been passed.

5. The respondents, in adherence to the directions given by this court and keeping in mind the rules and regulations, have now promoted the petitioner to the post of Junior Training Officer. If he is eligible, he would be promoted to the post of Assistant Training Officer and then to the post of Training Officer. Since there is no violation of the direction of this court, the contempt petition
