O R D E R
The present Criminal Original Petition has been filed seeking modification of the condition imposed by the learned Judicial Magistrate No.IV, Tiruppur, in E.C.M.P.No.3196 of 2025 dated 24.10.2025, directing the petitioner to execute a bond for Rs.7 lakhs with two sureties of an equal amount to the satisfaction of the Court, along with proof of the stated value. 2.
The brief facts of the case are as follows :- 2.1. The petitioner is the owner of the vehicle viz., a Maruti Suzuki Swift car bearing registration No.TN 39 CF 8626, which was seized by the respondent Police in connection with Crime No.390 of 2025 registered on the file of the respondent for the offences under Section 123 of BNS and Section 22(a) of the Cigarettes and Other Tobacco Products Act, 2023.
2.2. Thereafter, the petitioner filed a petition under Section 497 r/w 503 of BNSS in E.C.M.P.No.3196 of 2025 seeking interim custody of the vehicle. The learned Judicial Magistrate No.IV, Tiruppur, while granting interim custody of the vehicle on 24.10.2025, directed the petitioner to execute a bond for Rs.7,00,000/- with two sureties. Therefore, the present petition has been filed seeking to modify the said condition. 2/5

Learned counsel appearing for the petitioner submitted that the vehicle in question is a 2018 model and its present market value would not exceed Rs.75,000/-. He further submitted that the petitioner is the second owner of the said car. However, the learned Magistrate has imposed an onerous condition directing execution of a bond for Rs.7 lakhs. Hence, he prayed for modification of the condition.

Learned Government Advocate (Criminal Side) submitted that though the petitioner is the owner of the car, she is not an accused in this case.

Having heard the learned counsel on either side and taking into account the fact that the vehicle is a 2018 model, this Court is inclined to modify the condition imposed by the learned Judicial Magistrate IV, Tiruppur, in E.C.M.P.No.3196 of 2025 dated 24.10.2025, as follows :- "1. The petitioner shall execute a bond for a sum of Rs.75,000/- (Rupees Seventy Five Thousand only), with two sureties of an equal amount to the satisfaction of the Court concerned, along with proof of the stated value." 3/5

It is made clear that all other conditions shall remain unaltered.

With the above modification, this Criminal Original Petition stands allowed.
