Prayer: This Criminal Miscellaneous Petition is filed under Section 482 of Cr.P.C r/w. Section 528 of BNSS, 2023 praying to modify the condition in paragraph 6(ii) imposed in the order dated 09.10.2025 made in Crl.R.C.No.1985 of 2025 on the file of this Court. For Petitioner :

ORDER

This Criminal Miscellaneous Petition has been filed by the petitioner seeking to modify the condition imposed by this Court in Paragraph No.6(ii) of the Order dated 09.10.2025 in Crl.R.C.No.1985 of 2025. 1/5

2. The learned counsel for petitioner submitted that since the petitioner is 2nd owner of the vehicle which was seized by respondent Police, he is not having the original invoice or bill of the said vehicle. Hence, petitioner is not in a position to deposit the original invoice or bill of the vehicle before the concerned Magistrate. However, the petitioner is willing to deposit the original Registration Certificate before the concerned Magistrate. Therefore, the learned counsel prayed that the condition imposed by this Court in Paragraph No.6(ii) of the Order dated 09.10.2025 in Crl.R.C.No.1985 of 2025 may be modified and the petitioner may be permitted to deposit the original Registration Certificate before the learned District Munsif cum Judicial Magistrate, Edappadi.

3. The learned Government Advocate (Crl.Side) appearing on behalf of respondent Police submitted that he has no serious objection to this petition being allowed.

4. Considering the submissions made by the learned counsel on either side, this Court is inclined to allow this petition and modify the condition 2/5

imposed by this Court in Paragraph No.6(ii) of the Order dated 09.10.2025 in Crl.R.C.No.1985 of 2025 as prayed by the petitioner.

Accordingly, this Criminal Miscellaneous Petition is allowed and the condition imposed by this Court in Paragraph No.6(ii) of the Order dated 09.10.2025 in Crl.R.C.No.1985 of 2025 is modified as follows: "(ii) the petitioner shall deposit the original Registration Certificate (R.C.Book) before the concerned Magistrate."

6. In all other aspects, Order dated 09.10.2025 in Crl.R.C.No.1985 of 2025 shall remain unaltered. Registry is directed to issue a fresh order copy to all concerned, after carrying out the aforesaid modification. 24.11.2025 mrr Index: Yes/No Speaking Order (or) Non-Speaking Order 3/5
