ORDER

The petitioners, who apprehend arrest by the respondent police for the offences punishable under Sections 296(b), 115(2), 118(1) and 351(3) of BNS, in Crime No.242 of 2025, on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioners is that on the date of the alleged occurrence, due to a wordy quarrel, the petitioners assaulted the defacto complainant with a wooden log, causing injuries to him and also criminally intimidated him. Hence, the complaint.

3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and have been falsely implicated in this case. He further submitted that the co-accused was released on bail by this Court. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court. Hence, he prays for the grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that the petitioners herein are ranked as A1 and A3. He further submitted that the

petitioner/A1 has seven previous cases and the petitioner/A3 has five previous cases pending against them. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Heard the learned counsel for the petitioners and the learned Special Public Prosecutor for the respondent and perused the materials available on record.

6. Considering the submissions made by the learned counsel on either side, and taking into account the bad antecedents of the petitioners and the likelihood of their involvement in similar offence, if they are released on bail, this Court is not inclined to grant anticipatory bail to the petitioners.
