O R D E R

The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 303(2), 326(a), 109, 132 of BNS Act, 2023 in Crime No. 482 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioners is that the petitioners had illegally transported 1/2 unit of river sand by using lorry bearing Registration No. TN-51-J-1285 without any valid licence from the Government. Hence the respondent police registered a case against the petitioners.

3. The learned counsel for the petitioners submits that the petitioners are innocent persons and they have been falsely implicated in this case based on the confession statement of A1. He further submits that they have not committed any offence as alleged by the prosecution. He also submits that the petitioners are ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for their release. Hence, he prays for grant of anticipatory bail to the petitioners. 2/3

4. The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that the petitioners are ranked as A2 and A3. He also submits that the petitioner/A2 is having three previous cases and the petitioner/A3 is having four previous cases, therefore, he opposed to grant anticipatory bail to the petitioners. 5.Taking into the above facts and circumstances of the case; that the petitioner/A2 is having three previous cases; that the petitioner/A3 is having four previous cases; if the anticipatory bail grants to the petitioners herein, they would damage the ecology and river bed, this Court is not inclined to grant anticipatory bail to the petitioners herein.
