interest at the rate of 9 percent per annum.

2. Heard the learned counsel on either side and perused the materials available on record.

Though this writ petition has been filed challenging the order passed by the third respondent dated 08.08.2025, there is an appellate remedy available against the said order before the second respondent. Accordingly, the petitioner has also filed an appeal before the second respondent and it is pending for consideration.

4. In view of the above, this writ petition is not maintainable when an appellate remedy is very much available. However, the second respondent is directed to dispose of the appeal filed by the petitioner, after giving an opportunity of hearing to the petitioner, on merits and in accordance with law,

within a period of twelve weeks from the date of receipt of a copy of this order. In the meanwhile, the third respondent is directed to disburse the eligible retirement benefits to the petitioner and also the arrears of pension, if any, within a period of eight weeks from the date of receipt of a copy of this order.
