Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for issuance of Writ of Declaration, declaring the action of the respondents in not regularizing the services of the petitioner in the post of Nursing Officer (Group-B) in the available vacancy from the date of initial engagement viz. 10.09.2020 as illegal, arbitrary and contrary to law and consequently direct the
respondents to regularize the services of the petitioner in the post of Nursing Officer (Group-B) on the basis of the educational qualification and on the basis of long years of service rendered in the 3rd respondent Institute with effect from 10.09.2020 with all consequential salary, monetary benefits and other attendant benefits, along with arrears of monetary benefits. ORDER
This Writ Petition has been filed seeking issuance of Writ of Declaration, declaring the action of the respondents in not regularizing the services of the petitioner in the post of Nursing Officer (Group-B) in the available vacancy from the date of initial engagement, viz. 10.09.2020, as illegal, arbitrary and contrary to law and consequently direct the respondents to regularize the services of the petitioner in the post of Nursing Officer (Group-B) on the basis of the educational qualifications and the long years of service rendered by her in the 3rd respondent Institute, with effect from 10.09.2020, together with all consequential salary, monetary benefits, other attendant benefits and arrears thereof.
2.Heard the learned counsel appearing on either side and perused the materials available on record.
3.Considering the facts and circumstances of the case, the petitioners are at liberty to submit a representation before the third respondent and on receipt of such representation, the third respondent is directed to consider the same and pass appropriate orders on merits and in accordance with law, within a period of two weeks from the date of receipt of the representation. 4.With the above direction, this Writ Petition stands disposed of. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
