ORDER

This writ petition has been filed for the issue of writ of mandamus forbearing the respondents 1 to 3 from conducting any survey in the subject property based on the request made by the 4th respondent. 2.Heard Mr.R.Rajaramani, learned counsel appearing on behalf of the petitioner and Mr.D.Ravichander, learned Special Government Pleader appearing on behalf of respondents 1 to 3.

3.The case of the petitioner is that a suit is pending in O.S.No.149 of 2004 between the petitioner and the 4th respondent and others and while so, the

3/5 4th respondent was attempting to submit an application to conduct survey in the property. In is under these circumstances, the present writ petition has been filed before this Court.

4.In the considered view of this Court, the petitioner has approached this Court even without giving any representation/objection to the concerned authority. Under such circumstances, a writ of mandamus cannot be maintained and the petitioner cannot be allowed to directly approach this Court. 5.In view of the same, the relief as sought for by the petitioner cannot be granted by this Court and accordingly, this writ petition stands dismissed. No Costs.
