PRAYER : Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to cancel or delete the Aadhaar Identification issued to the Petitioner's mother, namely Mrs.Meenambal bearing Aadhaar No.8873 5111 3744, and consequently direct the respondents to issue an Aadhaar Card to the Petitioner within a time limit fixed by this Hon'ble Court.

O R D E R

This Writ Petition has been filed seeking a direction to the respondents to cancel or delete the Aadhar Identification issued to the petitioner's mother viz., Meenambal bearing Aadhar No.8873 5111 3744 with a consequential direction to the respondents to issue an Aadhaar Card to the Petitioner within a time limit to be fixed by this Court.

2. Mr.Venkatasamy Babu, learned Central Government Standing Counsel takes notice on behalf of the respondents.

It is the case of the petitioner that his request for issuance of Aadhaar card in his name has been rejected by the respondents on the ground that his biometrics matches with his mother's Aadhar Card and hence, the petitioner can obtain his aadhar card only after cancelling the Aadhar card which stands in the name of his mother. Hence, the petitioner has come up with the present Writ Petition seeking the aforesaid relief.

Learned counsel for the petitioner submitted that, at the time of enrolling for issuance of Aadhar card, thumb impression of the petitioner's mother could not be successfully captured and therefore, the petitioner was insisted by the authorities to keep his thumb impression instead of his mother and the same was recorded. Therefore, this Court may issue appropriate directions to the respondents to cancel the Aadhar card presently standing in the name of his mother and permit the petitioner to produce the death certificate of his deceased mother for such cancellation so as to enable the authorities to issue fresh Aadhar card in the name of the petitioner.

Learned Central Government Standing Counsel appearing for the respondents submitted that the Aadhar card standing in the name of the petitioner's mother will be cancelled upon receipt of necessary documents and fresh Aadhar card will be issued to the petitioner within the time that may be stipulated by this Court.

Recording the submission made by the learned Central Government Standing Counsel appearing for the respondents, this Court without expressing any opinion on the merits of the case, directs the petitioner to submit a fresh application seeking issuance of Aadhar Card before the respondents along with the death certificate of his mother and other necessary documents within a period of two (2) weeks from the date of receipt of a copy of this order. Upon receipt of 3/6

such application, the respondents are directed to consider the same and pass appropriate orders on merits and in accordance with law within a period of twelve (12) weeks thereafter after affording an opportunity of personal hearing to the petitioner and any other interested parties.

7. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
