O R D E R

The petitioner, who was arrested and remanded to judicial custody on 20.09.2025, for the offence punishable under Sections 8(c) r/w 20(b)(ii)(B) and 29(1) of the NDPS Act, 1985, in Crime No.333 of 2025 on the file of the respondent police, seeks bail. 1/4

2. The case of the prosecution is that the petitioner, along with A4, used to purchase Ganja from other States and supply the same to A1 to A3. On 19.09.2025, A1 to A3 were arrested and found in possession of 1.500 kilograms of Ganja. Based on their statements, the petitioner was arrested on 20.09.2025. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that no contraband was recovered from the petitioner and that his arrest is solely based on the alleged confession statement of the co-accused. It is further submitted that the petitioner has been in judicial custody since 20.09.2025. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that totally 5 accused in this case, and the petitioner is arrayed as A5. He further submitted that the petitioner has 5 previous cases; and that the investigation of this case is still pending. 2/4

5. Considering the facts, quantity of contraband involved in this case, the previous antecedents of the petitioner and taking note of the fact that the investigation of this case is still pending, this Court is not inclined to grant bail to the petitioner.
