ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Section 108 of BNS corresponds to section 306 of IPC in Crime No. not known of 2025, seeks anticipatory bail.

2. The case of the prosecution is that the victim girl, aged about 18 years, was working under the petitioner in a shop. Somehow, the petitioner herein had developed a relationship with the victim and had sexual intercourse with the promise of marrying her. Since he refused to marry her inspite of her request, she committed suicide after writing a suicide note. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is only a Manager and his relationship with the victim is not like lover and victim was also having a love affair with other person. Since the petitioner has raised objections, she committed suicide. Therefore, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reported that the FIR was registered for suspicious death, and the suicide note revealed that the petitioner had sexual intercourse with her and subsequently refused to marry her. Hence, the victim girl committed suicide by hanging. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances,and that the investigation is at a preliminary stage, I am not inclined to grant anticipatory bail to the petitioner.
