ORDER

This Criminal Miscellaneous Petition has been filed seeking suspension of the sentence imposed on the petitioner by the Trial Court vide Judgment dated 27.12.2022 made in C.C.No.8 of 2019 on the file of the Special Judge, Special Court under TNPID Act, Coimbatore and to enlarge the petitioner on bail pending disposal of the Criminal Appeal No.108 of 2023. 2.

It is seen that the petitioner had earlier been granted interim bail subject to certain conditions imposed by the Trial Court. However, the petitioner failed to comply with the said conditions. Consequently, the interim bail granted to the petitioner was cancelled and he was secured to undergo the remaining period of sentence. Hence, the petitioner has failed to make out a prima facie case to suspend the sentence.

In view of the above, this Court is not inclined to grant suspension of sentence to the petitioner. Accordingly, this Criminal Miscellaneous Petition is dismissed.
