ORDER

This petition has been filed seeking a direction to the first respondent to consider the petitioner representation dated 06.10.2025 and consequently direct the 1st respondent may permit the petitioner to Return Sri Lanka or SWITZER LAND.

2. It is the case of the petitioner that the petitioner was being a Sri Lanka and she has presently residing in India and has been implicated in a case relating to the alleged possession of a forged Indian Passport. However, the petitioner in possession of her original Sri Lankan Passport which is valid upto 13.11.2033 at Sri Lanka which establishes her nationality and identify as a bonafide citizen of Sri Lanka. Further the petitioner obtained valid Visa for Switzerland. Hence, the petitioner send a representation on 06.10.2025 to the first respondent for seeking to issue necessary orders permitting the petitioner to travel back to Sri Lanka or Switzerland using her valid Sri Lankan Passport and Switzerland Visa.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Government Advocate appearing for the second respondent submitted that investigation is pending and the minimum investigation period is six months. Therefore, the petitioner cannot be sent from India at this stage. Hence, the writ petition is liable to be dismissed.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Recording the submission made by the learned Government Counsel, the writ petition is disposed of with a direction to the second respondent to conclude the criminal proceedings as against the petitioner as expeditiously as possible and after completion, the same will be intimated to the first respondent to enable the petitioner to return to Sri Lanka or Switzerland.
