O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 115(2), 118(1) and 351(3) of BNS, 2023 in Crime No.384 of 2025, on the file of the respondent Police, seek anticipatory bail.

2. It is seen that, earlier this Court dismissed the petitioner's anticipatory bail petition of the petitioner on 23.10.2025 in Crl.O.P.no.28678 2/6

of 2025 by stating the following reasons:

Considering the submissions made by the learned Government Advocate, it appears that the petitioner, along with the other accused allegedly attacked the defacto complainant with iron rods and caused injuries. Though the injured person was discharged from the hospital, since the petitioner is a habitual offender having three previous serious cases pending and the investigation is still in progress, granting anticipatory bail to the petitioner at this stage would hamper the investigation and may embolden him to indulge in similar activities. Hence, I am not inclined to grant anticipatory bail to the petitioner.

3. The learned counsel for the petitioner submitted that after dismissal of the bail order of the petitioner, co-accused were granted bail in Crl.O.P.No.28916 of 2025 by order dated 25.09.2025. Hence, prays for grant of anticipatory bail to the petitioner 3/6

I have gone through the order passed in Crl.O.P.No.28916 of 2025 and this Court is of the view that the petitioners could not be placed on parity with the persons, who have been granted bail, since petitioner has perevious cases. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
