ORDER
This writ petition has been filed by the petitioner seeking to direct the respondents 1 to 4, to dispose of the petitioner's representation dated 09.12.2023
and to disburse the land acquisition compensation amount to the petitioner and her sister Sivagami, with respect to the lands in S.Nos.240/2 (55 cents) 186/3 (1.14 acres) 186/9 (96 cents) 247/3 (61 cents) and S.No.240/1 (1890 Sq, ft,) in Punnapakkam Village, Uthukottai Taluk, Thiruvalluvar District. 2.Mr.M.R.Gokul Krishnan, learned Additional Government Pleader, takes notice on behalf of the respondents 1 to 4. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself. 3.Learned counsel for the petitioner would submit that the lands comprised in S.Nos.240/2 (55 cents) 186/3 (1.14 acres) 186/9 (96 cents) 247/3 (61 cents) and S.No.240/1 (1890 Sq, ft,) in Punnapakkam Village, Uthukottai Taluk, Thiruvalluvar District, belongs to her father.
The petitioner along with her sister inherit the aforesaid property from their father. The subject property along with other adjacent lands were acquired by the 2 nd respondent for the purpose of laying six lane road from Punnapakkam to Thiruvallur Bypass Road.
extent of their 1/4 th share, the 2 nd respondent has given the compensation to the to the other family descendants/ the respondents 5 to 11, who are entitled to 3/4 th share of the subject property and not the 1/4 th share which belongs to the petitioner and her sister. In this regard, the petitioner made a representation letters dated 09.12.2023 to the respondents 1 to 4. However, the said representation is not considered by the respondents till date. Hence, the present writ petition has been filed.
4.Learned Additional Government Pleader appearing for the respondents 1 to 4 would submit that the representation of the petitioner dated 09.12.2023, will be considered within a period six weeks. 5.Heard the learned counsel for the petitioner as well as the learned Additional Government Pleader appearing for the respondents 1 to 4 and perused the materials available on records.
6.Considering the submissions made by either parties and in view of the limited prayer sought for in this Writ Petition, without going into the merits of the case, this Court directs the respondents 1 to 4 to consider the petitioner's representation dated 09.12.2023, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. 7.With the above said direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
