ORDER

This petition is filed to modify the condition "the petitioner shall deposit a sum of Rs.25,000/- (Twenty Five thousand only) as a non-refundable deposit by the way of demand draft to the credit of RAY OF LIGHT FOUNDATION, A/c.No.50100078904233; IFSC Code: HDFC0001864; No.10, Nageshwara road, Nungambakkam, Chennai, Tamil nadu 600 034; Ph.No.8939065431.

2. The petitioner, who was arrested for the alleged offence punishable under Sections 8(c), 20(b)(ii)(B), 29(1) of NDPS Act. Later he was remanded to judicial custody by the learned II Metropolitan Magistrate, Egmore, Chennai and now he is confined as remand prisoner in Central Prison-II, Puzhal, Chennai.

3. The petitioner was released on bail by this Court in Crl.O.P.No.19769 of 2025 dated 14.07.2025 while granting bail he was directed to deposit a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) as a non-refundable deposit.

4. Learned counsel for the petitioner submitted that the petitioner is not 2/4

having any source to deposit the money, as he is still languishing in prison. No final report has been filed. Hence, there is no possibility of the petitioner coming out of bail, unless he pays the amount ordered by this Court.

5. Considering the submissions made on both sides and considering the nature of the case, I am inclined to modify the deposit condition and accordingly, the condition that petitioner shall deposit Rs.25,000/- (Rupees Twenty Five Thousand only) as a non-refundable deposit alone is removed.

6. With the above direction, this Criminal Miscellaneous Petition stands ordered.
