The petitioners, who were arrested and remanded to judicial custody on 15.10.2025, for the offence punishable under Sections 7, 20(2) of Cigarette and other Tobacco Products Act, 2003 and Sections 123, 62, 275 of BNS in 1/4
Crime No.591 of 2025, registered on the file of the respondent, seeks bail.
2. The allegation against the petitioner is that the petitioners were found in possession of 120 kgs of banned tobacco products. Hence, the case.
3. The learned counsel appearing for the petitioners submitted that, petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that the marriage of the 2nd petitioner is also fixed next week. Hence, he prays for grant of bail to the petitioners.
4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and opposed for grant of bail to the petitioners. He further submitted that the investigation is not completed.
5. Considering the huge quantity of the contraband involved in this case and the fact that the investigation is pending, this Court is not inclined to grant bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. 2/4
