O R D E R

This writ petition has been filed for the issue of a writ of mandamus directing the respondents 2 and 3 to act upon the online application submitted by the petitioners on 27.03.2025, seeking for survey of the subject properties and for demarcation of boundaries.

2. Heard both sides and perused the materials available on record.

The case of the 1 st petitioner is that the subject property in S.No.77/1A was originally purchased by his father by virtue of a registered Sale Deed dated 01.09.1982 registered as document No.1208/1982. An extent of 67 cents of the other subject property in S.No.76/2A1 was allotted in favour of the petitioner through a Partition Deed dated 26.04.2018 registered as document No.4060/2018. This property was settled by the petitioner in favour of his wife/2 nd petitioner through a Settlement Deed dated 27.01.2020 registered as document No.780/2020 and the revenue records was also mutated in the name of the 2 nd petitioner. Insofar as a portion of the property in S.No.77/1A belonging to the 1 st petitioner's father, the petitioner's father settled the same in favour of the 1 st petitioner through a Settlement Deed dated 04.08.2021 registered as document No.8453/2021 and the revenue records were also mutated in the name of the 1 st petitioner. The petitioners submitted an application on 27.03.2025, seeking for survey of the land and for demarcation of boundaries in S.No.76/2A1.

4. The application was acted upon and when the authorities came to the premises of the land in S.No.76/2A1, the same was objected by the respondents 6 to 10 and hence, survey was not conduced. Thereafter, the petitioners 3/6

approached the 3 rd respondent and lodged a complaint and the same also did not evoke any response. It is under these circumstances, the present writ petition has been filed before this Court.

Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the respondents 2 and 3 to act upon the application submitted by the petitioners on 27.03.2025 and conduct survey in the subject properties and complete the process within a period of four weeks from the date of receipt of a copy of this order. The survey shall be conducted in the presence of respondents 6 to 10. If required, it is left open to the respondents 2 and 3 to take the aid of the 5 th respondent to ensure that the survey is conducted in a smooth manner.

The writ petition is disposed of with the above direction. No costs. 03.11.2025 Index : Yes/No (2/2) gya 4/6
