ORDER
(Order of the Court was made by the Hon'ble Chief Justice) Heard learned counsel for the parties.
2. Challenge to the establishment of an industrial unit by respondent No.7 is laid through this petition, styled as 'public interest litigation'.
3. We find that respondent No.7 has established its unit after obtaining due approval from the Pollution Control authorities, as also from other State authorities. None of these permissions is under challenge in this petition. Without challenge to the legality and validity of various permissions and approvals, including consent to operate, the petition is not maintainable.
4. We also find that, if challenge is to be laid to the consent to operate order issued by the Pollution Control authorities, the remedy lies before the appellate authority constituted under the Pollution Control Board Laws.
5. The writ petition is dismissed with liberty as aforesaid. There shall be no order as to costs.
