Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus, seeking a direction against the DRT, Coimbatore, to take up and dispose of SA No.624 of 2024 within a time frame as granted by this Hon'ble Court.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Learned counsel for bank would submit that S.A. pending before the Debts Recovery Tribunal, remains undecided and there is an interim order operating against the bank, due to which, bank is unable to realise debt from the secured creditor.

2. We do not know how many cases filed prior to S.A. in the present case are pending consideration before the Debts Recovery Tribunal. However, we would observe that in cases where stay has been granted by the Debts Recovery Tribunal, hearing of those cases should be expedited and concluded as early as possible,

keeping in view that because of the interim order, bank is unable to realise its debt from the borrower.

3. Petition is disposed of.
