The petitioner, who apprehends arrest by the respondent police for the offences punishable under Sections 281, 296(b), 126(2), 118(1), 351(3) of BNS, Act 2023 in Crime No.0399 of 2025 seeks anticipatory bail. 1/4
2.The allegation against the petitioner is that he joining hands with other accused attacked the defacto complainant with deadly weapons and caused injuries to him. Hence, the complaint. 3.The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that the arrested accused/A3 was already released on bail. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is ranked as A1 and that he has direct involvement in the alleged offence. He further submitted that the petitioner has six previous cases pending against him. However, he opposed for grant of anticipatory bail to the petitioner.
5. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl.side) and perused the materials available on record.
6. Considering the submissions made by the learned counsel on either side, the specific overt act attributed to the petitioner and the fact that the petitioner has six previous cases pending against him, this Court is of 2/4
the view that granting anticipatory bail to the petitioner, at this stage, would be appropriate, as there is every likelihood of the petitioner indulging in similar activities.
