The petitioner, who were arrested and remanded to judicial custody on 01.02.2025, for the offence punishable under Sections 8(c) r/w 22(b), 22(c) and 29(1) of NDPS Act, 1985 in Crime No.645 of 2025, registered on the file of the respondent, seeks bail.

2. The case of the prosecution is that this petitioner/A4 along with other accused had entered into a conspiracy for illicit transportation and sale of contraband. Pursuant to the said criminal conspiracy, they had possessed 75 grams of Methamphetamine for sale and the same had been seized by the respondent police. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has falsely implicated in this case. He would further submit that the petitioner is ready to abide any condition imposed by this Court. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police would submit that the contraband involved is of commercial quantity and hence the rigours of section 37 of the NDPS Act would arise in granting bail. He put forth the possibility of abscondence of the petitioner/A4 if ever released on bail. Hence, he strongly opposed the grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record.

Considering the quantity of the contraband seized from the petitioner is a commercial quantity and rigours of Section 37 of NDPS Act is applicable to this case and no grounds were made out for satisfying twin conditions of Section 37 of NDPS Act, this Court is not inclined to grant bail to the petitioners with certain conditions:
