This Civil Miscellaneous Petition has been filed to condone the delay of 233 days in filing the above appeal.

2. Heard the learned counsel for the petitioners.

3. Ms.N.B.Surekha, learned counsel takes notice for the 3rd respondent and she has got objections in allowing the petition.

4. The first petitioner would submit that, due to financial constraints, delay of 233 days occurred in filing the Civil Miscellaneous Appeal.

5. Accepting the averments made by the petitioners in the Affidavit enclosed with the petition,, this Court is inclined to allow this Civil Miscellaneous Petition subject to the condition that the interest for the delay period of 233 days shall stand waived.
