Criminal Original Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita/Section 482 Cr.P.C., to call for the records in Crime No.241 of 2025 dated 30.08.2025 on the file of the K-9 Thiru.Vi.Ka Nagar Police Station i.e., the respondent herein and quash the First Information Report filed in the above case.

The present Criminal Original Petition seeking to quash the First Information Report in Crime No.241 of 2025, on the file of the first 1/4

respondent police.

The case of the prosecution as projected by the de facto complainant is that the accused approached one Mansoor Basha on 20.10.2022 and on the same day, shared RC book and vehicle photos through WhatsApp. Thereafter, on 29.10.2022, the accused came to the office with the bike, shared the Aadhar card number and entered into a hirepurchase agreement and received a sum of Rs.8 lakhs as loan. Thereafter, the accused cheated the de facto complainant by failing to produce the original documents.

The learned counsel for the petitioner submitted that the petitioner is known to the said Mansoor Basha and that it was Mansoor Basha, who cheated the de facto complainant by producing fake documents. He further submitted that the petitioner is innocent and has been falsely implicated in this case.

The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the case has been registered very recently and that the prosecution case is that the accused, by producing fake documents, obtained a loan of Rs.8,00,000/- and cheated the de facto 2/4

complainant. He further submitted that the petitioner has also lodged a complaint and that both complaints have been referred to the Assistant Commissioner of Police, M.K.B.Nagar Police Station. He also submitted that the investigation is at a nascent stage and therefore, FIR cannot be quashed without a detailed enquiry.

Considering the allegations and the counter-allegations made by the parties against each other and taking note of the fact that the investigation is being conducted by the Assistant Commissioner of Police, M.K.B.Nagar Police Station, this Court is not inclined to quash the FIR at this initial stage. Accordingly, this Criminal Original Petition stands dismissed. Consequently, the connected Criminal Miscellaneous Petition is closed.
