O R D E R
The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Section 498(A) of IPC in Crime No. 1/6
51 of 2025, on the file of the respondent Police, seeks anticipatory bail.
2. The allegation against the petitioners is that the 1 st petitioner is the husband of the de-facto complainant and other petitioners are the in-laws of the de-facto complainant. On 12.06.2024, the 1 st petitioner married the defacto complainant and thereafter, he went to Coimbatore, for work and he developed an illegal intimacy with another woman. Subsequently, the 1 st petitioner harassed the de-facto complainant/wife and demanded more dowry and money from her. Further, it was intimated to the family members of the 1 st petitioner. In view of the request made by the family members of the 1 st petitioner, he escaped from further action. In the meanwhile, the 1 st petitioner/husband filed H.M.O.P.No. 34 of 2025 on the file of Subordinate Court, Sathyamangalam, seeking cohabitation and the same is pending. Hence the complaint.
3. The learned counsel for the petitioners submits that there is no illegal relationship between the 1 st petitioner and the another woman and it is 2/6
a false complaint lodged against him. He further submits that the 1 st petitioner filed H.M.O.P.No. 34 of 2025 on the file of Subordinate Court, Sathyamangalam, seeking restitution of conjugal rights. He also submits that the petitioners are ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for his release. Hence, he prays for grant of anticipatory bail to the petitioners.

The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that already matrimonial proceedings have been initiated by the 1 st petitioner/husband and other petitioners are the in-laws of the de-facto complainant. He further submits that the petitioners are in possession of 40 sovereigns of gold jewellery belongs to the de-facto complainant and the same was not returned to the de-facto complainant. He further submits that both the 1 st petitioner and the de-facto complainant were living with only within a short period of time.

Considering the facts and circumstances of the case and the major st petitioner/A1 and he is having an allegations are leveled against the 1 st illegal relationship with another woman and living separately; that the 1 petitioner/A1 is having 40 sovereigns of gold jewellery of the de-facto complainant, hence, this Court is not inclined to grant anticipatory bail to the st petitioner/A1 and therefore, this petition is dismissed against A1. Insofar as the petitioners/A2 to A4 are concerned, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions:-

Accordingly, the petitioners/A2 to A4 is ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date on which the order copy made ready, before the learned Judicial Magistrate, [Additional Mahila Court] Coimbatore, on condition that the petitioners shall execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties each for a like sum to 4/6
the satisfaction of the learned Magistrate concerned and on further condition that:
(a) If the petitioners fails to surrender before the concerned Magistrate, within a period of fifteen days from the date of receipt of a copy of this order, this order shall stand automatically cancelled;
[b] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;
[c] the petitioners/A2 to A4 shall report before the respondent Police daily at 10.30 a.m for a period of one week and thereafter, as and when required for interrogation;
[d] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioners in 5/6
accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court themselves as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[e] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 03.11.2025 MSM To 1.The Judicial Magistrate, [Additional Mahila Court] Coimbatore. 2.The Sub Inspector of Police AWPS-Central Police Station, Coimbatore City, Coimbatore District.
