O R D E R

This writ petition has been filed challenging the order dated 09.10.2025 on the file of the first respondent thereby rejecting the request made by the petitioner seeking photocopy of the documents on payment of necessary charges.

The petitioner is a delinquent on the disciplinary proceedings initiated by the first respondent against the petitioner. The petitioner joined in service as Assistant Professor under the first respondent on 25.10.1999 and subsequently he was promoted to the post of Associate Professor. Later, he was promoted as Director and he was posted at the Centre for Animal Health Studies, TANUVAS, Madhavaram. While being so, he was served with charge memo dated 23.09.2025 showing annexure III stating four documents. However, the petitioner was not served with photocopies of the documents. Therefore, 2/6

the petitioner could not submit his explanation for the charges. Hence, the petitioner requested the first respondent to furnish photocopies of the said documents, that too on payment of charges. However, the petitioner was permitted to inspect those documents and he was not served with photocopies, that too on payment of charges.

The first respondent, who is being the disciplinary authority, when serving the charge memo, is supposed to serve the documents along with the charge memo. Serving all the documents shown in the annexure along with the charge memo is mandatory. The petitioner is not supposed to ask for photocopies on payment of cost. The first respondent, being the disciplinary authority, is bound to serve the photocopies so that the petitioner can submit his explanation in a proper manner. The petitioner, being a delinquent, is entitled to the documents to submit his explanation to the charge memo. 4.

In view of the above, the order impugned cannot be sustained and the same is liable to be set aside. Accordingly, the 3/6

impugned order dated 09.10.2025 is set aside. The first respondent shall serve photocopies of the documents shown in Annexure-III of the charge memo dated 23.09.2025 within a period of two weeks from the date of receipt of this order. On receipt of the same, the petitioner is at liberty to submit explanation for the charges within a period of two weeks thereafter. Thereafter, the first respondent shall proceed with enquiry, if not satisfied with the explanation submitted by the petitioner. 5.

With the above directions, this writ petition stands allowed. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
