The petitioner, who was arrested and remanded to judicial custody on 06.08.2025, for the offence punishable under Sections 103(1), 190, 191(2) and 191(3) of BNS, 2023 in Crime No.207 of 2025, registered on the file of the respondent, seeks bail.

The allegation against the petitioner is that the petitioner is ranked as A1 and his father was murdered by the deceased in this case, enraged over the same, he awaited for an opportunity and while the deceased was in the shop, he along with other accused went there and attacked the deceased indiscriminately, due to which, deceased sustained grievous injuries and died on the spot. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner has been incarcerated for more than 88 days and major part of the investigation has been completed. Hence, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that it is a case of retaliation murder and petitioner has two previous cases pending against him and further submitted that the investigation is pending.

5. Considering the motive behind the occurrence and the fact that it 2/4

is a case of retaliatary murder and the investigation is pending, if the petitioner is released on bail, there is a likelihood that the petitioner will hamper the investigation, this Court is not inclined to grant bail to the petitioner.
