O R D E R

Mr.Stalin Abhimanyu, learned Additional Government Pleader takes notice on behalf of the 1st respondent. By consent, this Writ Petition is taken up for final disposal at the stage of admission itself.

This Writ Petition has been filed forbearing the 1st Respondent from registering any document of the 2nd respondent pertaining to the property of the petitioner measuring 3 Acres in Survey No.173/2B at Thimmarayanahalli village of Palacode Taluk, Dharmapuri District till the disposal of the Enquiry.

The learned counsel for the petitioner would submit that the petitioner and his Sister have filed a suit against the 2nd respondent and others with respect to the subject property in O.S.No.39 of 2025 and the same is pending. While so, the 2nd respondent is attempting to create a Settlement Deed in favour of her children with respect to the subject property. Therefore, the petitioner has submitted an objection to the 2nd respondent on 24.04.2025. Subsequently, the 1st respondent issued a notice to the 2nd respondent on 28.08.2025, but pending enquiry, the 2nd respondent is attempting to encumber the subject property. Hence, this petition.

4. The learned Additional Government Pleader appearing for the 1st respondent would submit that unless otherwise enquiry is completed and a decision is taken, the 1st respondent will not register the Settlement Deed presented by the 2nd respondent with respect to the subject property.

5. Recording the aforesaid suhmission made by the learned Additional Government Pleader appearing for the 1st respondent, this Writ Petition stands disposed of. It is made clear that the 1st respondent shall not 3/5

register the Settlement Deed presented by the 2nd respondent, without the completion of the enquiry proceedings. No costs. Consequently, connected Miscellaneous Petition is closed.
