With reference to the relief sought for in the present writ petition, the Tahsildar, Katpadi, has given a written instructions, which would show that during the course of survey, encroachments are identified. The subject land belongs to Village Panchayat. Therefore, under the provisions of the TamilNadu Panchayats Act, the Block Development Officer has to initiate

action by identifying the extent of encroachments and issue notice to the encroachers. If the encroachers fail to vacate the encroachments, thereafter, the Revenue Tahsildar has to initiate eviction proceedings under the provisions of the Tamilnadu Land Encroachments Act, 1905.

2. Therefore, it would be sufficient that a report has been submitted by the Tahsildar to Block Development Officer. The Tahsildar has to follow the procedures and thereafter, ensure that the encroachers identified are removed in accordance with law. The said exercise is directed to be completed within a period of twelve weeks from the date of receipt of a copy of this order. Accordingly, the Writ Petition is disposed of. No costs. (S.M.S.,J.)
