ORDER
This Writ Petition has been filed seeking a direction to the respondents to consider the representation submitted by the petitioner, seeking pension in the cadre of Office Assistant by counting his entire service from 07.08.1991. 2.Heard the learned counsel appearing on either side and perused the materials available on record.
3.A perusal of the records reveals that the petitioner was appointed as Night Watchman on consolidated salary. Thereafter, he claims to have worked as an Office Assistant and retired from service on 31.03.2020. The petitioner has now claimed pensionary benefits under the cadre of Office Assistant and sought refixation of pension based on the order in O.A.No.5917 of 1996. Originally, the petitioner filed an application before the Tamil Nadu Administrative Tribunal in O.A.No.5917 of 1996, which was subsequently transferred to this Court and 2/4
re-numbered as W.P.No.31145 of 1996. A perusal of the prayer sought for in the writ petition reveals that the petitioner had sought promotion to the post of Record Clerk. However, the said writ petition was dismissed for default on 11.09.2008. Therefore, the petitioner was never promoted to the post of Office Assistant. 4.In view of the foregoing reasons, the relief sought for in this writ petition cannot be granted. Thus, the writ petition lacks merits and is liable to be dismissed. Accordingly, this writ petition stands dismissed. There shall be no order as to costs.
