JUDGEMENT This Criminal Revision Case has been filed to set aside the order dated 26.09.2025 in Crl.M.P.No.12311 of 2025 in STC No.8022 of 2024 passed by the Metropolitan Magistrate FAST TRACK COURT-I Judge at Allikulam.
2. The petitioner herein filed Crl.M.P. No. 12311 of 2025 in S.T.C No. 8022 of 2024 on the file of the Metropolitan Magistrate FAST TRACK COURT-I Judge at Allikulam, seeking to reopen the defence side evidence and produce the documents. On hearing both sides, the Trial Court held that it is unnecessary to receive the documents and recall DW1 for marking the same. Aggrieved over the same, the petitioner filed this Criminal Revision Case.
3. The learned counsel for the petitioner submits that the petitioner running a NGO for that he received donations from the defacto complainant, in order to produce the receipts with regard to payment of donations the petitioner filed the petition to reopen the defence side evidence but the said petition was dismissed by the Trial Court. If this petition is not allowed his valuable right to prove his case will be defeated. Hence, he prays to allow this petition.
4. Heard the submission of the learned counsel for the petitioner.
5. On perusal of the records, it reveals that the petitioner running a Trust under the name and style of M/s. TANCCAO(Tamil Nadu Cyber Crime
Awareness Organization), In the said Trust the defacto complainant also taken part in some of the proceedings to that effect petitioner produced the photographs which shows that the defacto complainant and the petitioner have some relationship with regard to the said Trust as well attended others proceedings as participants during the course of the same there was transaction with regard to donation. To prove his defence the petitioner wants to mark those documents, whether it is relevant or not is decided only at the completion of trial. If the opportunity is not given to the petitioner, his valuable right will be defeated. Hence, the findings of the Trial Court is set aside and D.W1 is reopened and petitioner is permitted to mark the documents. Further, the petitioner shall cooperate for the Trial proceedings.
