2. Tr.C.M.P. No.1245 of 2025 has been filed by the petitioner/wife under Section 24 of the Code of Civil Procedure seeking withdrawal of H.M.O.P. No.70 of 2025 pending on the file of the Family Court, Nagapattinam and to transfer the same to the file of the Family Court, Chennai.

3. Tr.C.M.P. No.134 of 2026 has been filed by the petitioner/wife under Section 24 of the Code of Civil Procedure seeking withdrawal of G.W.O.P. No.41 of 2025 pending on the file of the Principal District Judge, Nagapattinam and to transfer the same to the file of the Family Court, Chennai.

4. Both H.M.O.P.No.70 of 2025 and G.W.O.P.No.41 of 2025 are instituted by the husband/respondent in Nagapattinam.

5. The learned counsel for the respondent would submit that the respondent is residing abroad. It is submitted that the child is with the petitioner. In the above facts and circumstances, this Court is inclined to allow both the transfer petitions. 3/6

6. Accordingly, Tr.C.M.P. No.1245 of 2025 is allowed and H.M.O.P. No.70 of 2025 pending on the file of the Family Court, Nagapattinam is withdrawn and transferred to the file of the Family Court, Chennai.

7. Tr.C.M.P. No.134 of 2026 is allowed and G.W.O.P. No.41 of 2025 pending on the file of the Principal District Judge, Nagapattinam is withdrawn and transferred to the file of the Family Court, Chennai.

8. The Family Court, Nagapattinam and the Principal District Judge, Nagapattinam, respectively, are directed to transmit the entire records forthwith to the Family Court, Chennai. The Family Court, Chennai shall take up the matters and proceed in accordance with law as expeditiously as possible. Consequently, connected miscellaneous petitions, if any, are closed.
