Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 3 to 6 to rectify the mistake/error crept in field measurement book (FMB Sketch) for the properties in Survey No.261 and 262 situated at Bagalur Hosur Main Road, Bagalur Village & Panchayat, Hosur Taluk, Krishnagiri District by considering the petitioner's representation dated 25.09.2025 within a time period that will be fixed by this Court.

ORDER

This Writ Petition has been filed seeking for rectification of the FMB sketch for the property more fully described in the prayer to this Writ Petition.

Even though, a counter has been filed by the respondents in this Writ Petition, it is an admitted fact that till date no final order has been passed on the petitioner's representation seeking for rectification of the FMB sketch to the property more fully described in the prayer to this Writ Petition. In the counter, though the respondents have taken a stand that the petitioner is not entitled for rectification of the FMB sketch, this Court is of the considered view Page No.2 of 6

that since no final order has been passed on the petitioner's representation prior to the filing of this Writ Petition, necessarily the respondents will have to pass a final order in the said representation to enable the petitioner to challenge the same if the said representation is rejected by the respondents by giving reasons. 3.

This Court is of the considered view that no prejudice would be caused to the respondents, if a direction is issued to the fourth respondent to pass a final order on merits and in accordance with law on the petitioner's representation seeking for rectification of the FMB sketch for the property more fully described in the prayer to the Writ Petition based on the petitioner's representation dated 25.04.2025 within a time frame that fixed by this Court. This Court is not expressing any opinion on the merits of the representation submitted by the petitioner.

For the foregoing reasons, this Court directs the fourth respondent to pass a final order on the representation submitted by the petitioner dated 25.04.2025 seeking to rectify the alleged mistake/error in the FMB sketch for the property more fully described in the prayer to this Writ Petition, within a period of twelve weeks from the date of receipt of a copy of this Order. With the aforesaid directions, this Writ Petition is disposed of. There shall be no order as to costs.
