ORDER
The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 120B, 420 & 506(1) of IPC, in Crime No.19 of 2025, on the file of the respondent Police, seek anticipatory bail.
2.The allegation against the petitioners is that the petitioners along with A1 and A2, collected Rs.28 lakhs from the defacto complainant on the promise of selling the land in Yercaud Muluvi Village, and subsequently swindled the amount, thereby cheated the defacto complainant. Hence, the case. 3.The learned counsel for the petitioners submitted that the petitioners are employees, not directly involved in transactions, and are falsely implicated in this case. He further submitted that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioners.
4.The learned Government Advocate (Crl.Side) for the respondent reported that there are five accused, including the petitioners who are ranked as A3 to A5, involved in canvasing and promising sale of land. Hence, he opposed for the grant of anticipatory bail to the petitioners. 5.I have also considered the submissions made on both sides and also perused the FIR and it reveals that the majority of the allegations are only leveled against A1 and A2. The petitioners allegedly involved in canvasing and supporting A1 and A2, I am of the view that custodial interrogation of the petitioners is not necessary, I am inclined to grant anticipatory bail to the petitioners, subject to certain conditions.

Accordingly, the petitioners are ordered to be released on anticipatory bail in the event of arrest or on their appearance, within a period of fifteen (15) days from the date of receipt of a copy of this order before the learned Judicial Magistrate No.V, Salem, on condition that the petitioners shall execute a separate bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only), each
with two sureties, each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that: (a) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
(b) the petitioners shall report before the respondent police, everyday at 10.30 a.m., for a period of two weeks and thereafter as and when required for interrogation; (c) the petitioners shall not tamper with evidence or witness either during investigation or trial;
(d) the petitioners shall not abscond either during investigation or trial;
(e) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;
(f) if the accused thereafter absconds, a fresh FIR can be registered under
Section 269 of B.N.S.
