ORDER

The learned counsel appearing for the petitioner would submit that the petitioner is the owner of the property situated at Tiruvannamalai Town, Tiruvannamalai Taluk, Tiruvannamalai District comprised in T.S.No.1802/2 to an extent of 4.77 acres. The title was confirmed in favour of the petitioner by way of two civil suits in O.S. No.908 of 1929 and O.S. No.1165 of 1990 on the file of the District Munsif Court, Tiruvannamalai and the Additional District Munsif II, Tiruvannamalai respectively and eventhen, the respondents decided to encroach the petitioner's property by construction of a Tidel Park.

2. Aggrieved by the same, the present writ petition has been filed. However, the learned counsel for the petitioner seeks liberty of this Court either to file an execution petition before the competent Execution Court or to file a

civil suit before the competent Civil Court.

3. In view of the above, without expressing any opinion, liberty is granted to the petitioner to workout the remedies before the Civil Court or competent Court in the manner known to law.

4. Accordingly, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed.
