ORDER

This writ petition is filed to direct the respondents 1 to 5 to consider petitioner representation dated 24.04.2023 and to pass appropriate orders. 2.The learned counsel for the petitioner would submit that the petitioner is the second wife of one G.Narasimman and that their marriage was performed

in the year 1998 and they are blessed with one male child viz., Srinivasan, aged about 23 years. Prior to the petitioner's marriage, there was a first marriage in between the petitioner's husband and one Lakshmi, who is the fifth respondent herein and since the said Lakshmi did not bear any child to the petitioner's husband, the petitioner's husband married the petitioner. Further that, the petitioner's husband died on 19.02.2023 and after his death, the petitioner made an application for issuance of legal heir certificate to his legal heirs, including the petitioner's son. However, no order has been passed on the representation of the petitioner till date. Hence, the present writ petition. 3.

The learned counsel for the petitioner would submit that a direction be issued to the respondents to consider the representation of the petitioner dated 24.04.2023 and to issue a legal heir certificate to the petitioner and her son. 4.

Tahsildar and thereafter, the application of the petitioner will be considered within a time as stipulated by this Court.

5.Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents and perused the materials available on record.

6.Since no adverse order is passed against the fifth respondent, notice to the fifth respondent is dispensed with.

7.In view of the facts and circumstances of the case, this Court suo motu impleads the Tahsildar, Iddayarpalayam, Coimbatore District as the sixth respondent.

8.The petitioner is now required to file a fresh application before the sixth respondent Tahsildar within a period of two (2) weeks from the date of receipt

of a copy of this order. Thereafter, the sixth respondent shall consider the same and pass appropriate orders, in accordance with law, after providing an opportunity of hearing to the petitioner and also the fifth respondent, within a period of six weeks. In case, a legal heir certificate is issued in favour of the fifth respondent, liberty is granted to petitioner to prefer an appeal before the concerned Revenue Divisional Officer, in the manner known to law. 9.The writ petition is disposed of accordingly.
