ORDER

This writ petition has been filed for a direction directing the respondents to disburse the differential sum of gratuity and leave encashment benefits based on the dearness allowance revision with effect from 01.01.2024 with interest.

2. The petitioner had joined in the respondent Corporation as a Junior Tradesman. Thereafter, he retired from service on 31.01.2024 and he was settled with all benefits as per dearness allowance granted to the employees at 46% of basic pay as on 01.07.2023. However, dearness allowance was revised from 01.01.2024 to 50% of basic pay. Therefore, the petitioner is entitled for 4% differential sum of gratuity and also leave encashment benefits.

3. In view of the above, the respondents are directed to disburse the differential sum of gratuity and leave encashment benefits with effect from 01.01.2024 with interest at the rate of 6% per annum, within a period of 12 weeks from the date of receipt of a copy of this order. 2/4
