Respondent(s) PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Certiorarified Mandamus, calling for the records relating to the order passed by the 4 th respondent in Na.Ka.No.01/ 2024/SIPCOT Nilai-4/Alagu-3 dated 27.06.2024 and quash the same; consequently direct the respondents to either allot alternative cultivable land to the petitioner and his family or reassign the acquired lands comprised in survey No. 135/9B2 measuring an extent of 0.23 hectares and Survey No. 133/5 measuring an extent of 0.64 hectares, situated at Attakurukki Village, Shoolagiri Taluk, Krishnagiri District.

ORDER

This writ petition has been filed by the petitioner challenging the order passed by the 4 th respondent in Na.Ka.No.01/2024/SIPCOT Nilai-4/Alagu-3 dated 27.06.2024, whereby rejecting the objection raised by the petitioner for acquiring his land.

2.Mr.P.Sathish, learned Additional Government Pleader, takes notice on behalf of the respondents 1, 2 and 4 and Mr.Abishek Murthy, learned Standing rd respondent. By consent of the parties, Counsel takes notice on behalf of the 3 the main writ petition is taken up for disposal at the admission stage itself. 3.Learned counsel for the petitioner would submit that the petitioner owns the agricultural lands situated in S.No.133/5 measuring 0.64 hectares and S.No.135/9B2 measuring 0.23 hectares at Attakurukki Village, Shoolagiri Taluk, Krishnagiri District and cultivating the same from the year 1991. While so, the Government of Tamil Nadu issued notifications dated 05.09.2023 and 11.09.2023, proposing the acquisition of petitioner's land along with other

adjacent lands for the establishment and expansion of the SIPCOT industrial area at Shoolagiri. Pursuant to the said notification, the petitioner and his mother was called for enquiry. In compliance, they appeared and filed their objection stating that they have no other means of livelihood apart from the said lands and requested to reassign the said land. However, the 4 th respondent by order dated 27.06.2024, rejected their objections stating that the lands had already been acquired from the other land owners and compensation was also disbursed to them. Aggrieved over the same, the petitioner preferred an appeal before the District Collector, Krishnagiri. The Collector vide communication dated 13.02.2025, directed the 2 nd respondent to take necessary action. Despite such direction, no further steps have been taken. Hence, the present writ petition has been filed.

4.Learned Additional Government Pleader appearing for the respondents 1, 2 & 4 would submit that since the lands were acquired for the industrial purpose, the compensation was awarded higher than a market value and for the petitioner the compensation amount would come more than a Crore. Therefore,

the petitioner cannot be considered as landless poor. Out the compensation amount, the petitioner can very well purchase the property. Further, the lands adjacent to the petitioner's property were acquired and the compensation also disbursed to the land owners. Therefore, the petitioner's objection cannot be entertained. In case the petitioner's request is entertained, the other land owners may come with the same plea of re-assignment of land or to provide alternate land for cultivation instead of compensation. Only the petitioner is not handing over the land. Hence, he prayed to dismiss the present writ petition. 5.Heard the learned counsel for the petitioner; learned Additional Government Pleader appearing for the respondents 1, 2 & 4 and the learned Standing Counsel appearing for the 3 rd respondent.

6.Considering the submissions made by the either parties, it is evident that the respondents have issued notification dated 05.09.2023 and 11.09.2023 for the purpose of acquisition of petitioner's lands to an extent of 2.1498 acres along with other lands. However, the petitioner requested for re-assignment of

land acquired or to provide alternate cultivating land instead of granting compensation. Such request has only been made by the petitioner and other land owners have handedover their land and received the compensation. Therefore, the respondent rejected the petitioner's request and passed the impugned order dated 27.06.2024.

7.Such being the case, this Court is of the view that as rightly contended by the learned Additional Government Pleader appearing for the respondents 1, 2 & 4, if the respondents are directed to issue alternate cultivating land for the petitioner instead of compensation, the other land owners may also claim for the same. Further, in the present case, since the lands were acquired for the industrial purpose, higher compensation has been awarded and for the petitioner the compensation would come more than a Crore. Therefore, the petitioner will not come under the category of landless poor and the petitioner can very well purchase the land for cultivation. Hence, this Court does not find any error in the order passed by the 4 th respondent rejecting the request of the petitioner and the present writ petition is devoid of merits.

8.In the result, the present writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. 17-11-2025 rst Index:Yes/No Speaking/Non-speaking order Internet:Yes
