Respondents PRAYER Writ Petition filed under Article 226 of the Constitution of India, seeking to issue a Writ of Mandamus, directing the 2nd respondent herein to consider and pass orders on the Petitioner's representation dated 29.06.2022 for including the petitioner's 5th and 6th singles on the Interstate Agreement in light of the letter dated 29.11.2024 sent by the State Transport Authority, Bangalore. ORDER

The petitioner seeks orders from the second respondent for including 5th and 6th singles for the State Carriage Permit operating the route Balathotanapally to Bangalore.

2. The petitioner was granted additional tour singles (5th and 6th singles) and times were fixed thereon by the second respondent on 28.05.1984. The grant so made by the State of Tamil Nadu was also countersigned by the Karnataka State Transport Authority on the condition that the petitioner will pay taxes to the Government of Karnataka. The petitioner was enjoying this benefit till G.O.Ms.No.16, Home, Prohibition and Excise (Transport III) dated 07.01.2008. By this order, the number of trips on Bangalore to Balathotanapally (via) Hosur and Denkanikottaa was restricted to 4(four).

3. The petitioner approached the second respondent seeking restoration of 5th and 6th singles. By an order dated 04.05.2022, the second respondent informed the petitioner that inclusion of additional singles can be considered only with the concurrence of the Karnataka State Authority and will certainly be taken into consideration at the next supplemental Interstate agreement.

4. The petitioner immediately approached the High Court of Karnataka at Bangalore and sought a direction to the Government of Karnataka and the

Karnataka State Transport Authority to include the additional two singles, as per Interstate agreement Clause VIII and IX of the agreement, between the States of Karnataka and Tamil Nadu as per the proceedings dated 29.06.2022 and 07.12.2022. The High Court directed the State of Karnataka to pass orders on the same.

Taking into consideration the orders of the High Court, the Commissioner of Transport and Road Safety, Bangalore informed the petitioner that inclusion of two additional single trips, as per the representation made by the petitioner, can be considered only by the Primary Permit Authority, namely the second respondent herein, at the time of next supplemental Interstate agreement. Hence, the petitioner was directed to approach the second respondent. The petitioner approached the second respondent by way of a representation and since it did not bear fruit, he is back before this Court.

6. I heard Mr.S.Sarath Kumar, learned counsel for the petitioner and Mrs.Meera Arumugam, learned Additional Government Pleader appearing for the respondents.

7. The narration of facts would go to show that the additional singles that the petitioner seeks, can be granted only post the Interstate Agreement.

8. Mrs.C.Meera Arumugham states that as on today, the States of Karnataka and Tamil Nadu are yet to enter into an agreement.

9. Therefore the mandamus that the petitioner seeks, cannot be granted at this stage. Once the States of Karnataka and Tamil Nadu enter into an agreement, the petitioner's right to seek inclusion of the 5th and 6th singles will arise. In view of the same, the writ petition is misconceived.

10. With the liberty aforesaid, this writ petition stands dismissed. No costs.
