ORDER

The Petitioner, who was arrested and remanded to judicial custody on 06.10.2025 for the alleged offences punishable under Section 63(d)(v), 64(2(i), 64(2)(m), 123, 77, 49, 351(2) of BNS Act r/w 66(E) of the 1/4

Information Technology Act (Amendment Act) @ 64(2)(m), 66, 351(2) of BNS Act, in Crime No.34 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against this petitioner is that this petitioner along with other accused threatened the victim and they would circulate her photos and videos on social media. The petitioner committed sexual intercourse with the victim girl. The victim girl got pregnant. Based on their relationship, the petitioner and the victim girl are stated to have had physical intimacy on multiple occasions. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner was arrested and he is in judicial custody from 06.10.2025 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the victim girl aged about 20 years, the petitioner aged about 44 years, the petitioner already married and having two kids, the victim got pregnant, investigation in this case is not 2/4

completed, and he opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the facts and circumstances of the case and the submissions made by both counsel and also considering gravity of offences committed by the petitioner, the investigation is not yet completed and if he is released on bail, there is possibility of tampering the witnesses and hampering the investigation, this Court is not inclined to grant bail to the petitioner at this stage.
