ORDER

The petitioner herein, who was arrested and remanded to judicial custody on 14.03.2025 for the offences punishable under Sections 331(4) and 305(a) of BNS in Crime No.40 of 2025, registered on the file of the respondent police, seeks bail.

The allegation against the petitioner is that, the petitioner joined hands with other accused, broke open the defacto complainant's house and committed theft of 6.5 sovereigns of gold jewels. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 14.03.2025; and that the petitioner is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the 2/4

prosecution case and submitted that there are two accused involved in this case and the petitioner is arrayed as A1; that the petitioner has five previous cases; that the stolen properties were recovered; and that the major part of the investigation has been completed.

Considering the submissions made on both sides, grave nature of offence, though the stolen properties in this case were already recovered, considering the previous antecedents of the petitioner and if the petitioner is enlarged on bail, he would indulge in similar offence, hence this Court is not inclined to grant bail to the petitioner. 6.

Accordingly, this criminal original petition stands dismissed. 11.11.2025 stn K. RAJASEKAR, J.
