The petitioner, who was arrested and remanded to judicial custody on 27.09.2025, for the offence punishable under Sections 275, 123 of BNS Act r/w Section 7(1) & 20(2) of the Cigarettes and Other Tobacco Products Act, in Crime No.992 of 2025, registered on the file of the respondent, seeks 1/4

bail.

2. The case of the prosecution is that this petitioner joining hands with other accused and found in possession of 537.800 kilograms of banned tobacco products. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 27.09.2025. He further submitted that the petitioner is only a labourer under A1 and was not aware of the contraband transported in the car. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that totally 5 accused in this case, and the petitioner is arrayed as A2. He further submitted that the petitioner has 5 previous cases; and that the investigation of this case is still pending. 2/4

5. Considering the facts, quantity of contraband involved in this case, the previous antecedents of the petitioner and taking note of the fact that the investigation of this case is still pending, this Court is not inclined to grant bail to the petitioner.
