These Petitions have been filed i) to condone the delay of 53 days in filing the petition to set aside the abatement caused due to the death of the first respondent in the second appeal, ii) to set aside the abatement and iii) to bring on record the proposed respondents.

2. Heard the learned counsel for the petitioners and the learned counsel for the respondents, and perused the materials available in the record.

3. On being satisfied with the averments stated in the affidavit filed in support of the petitions and the submissions made by the learned counsel for the petitioners, these petitions are allowed.

4. The Registry is directed to carry out necessary amendment and list the Second Appeal on 09.04.2026.

5. Issue notice to the newly added respondents in the second appeal. Private Notice is also permitted.
