ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 126(2), 115(2), 118(1), 351(3) of BNS, 2023 on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that there was wordy quarrel between the petitioner and the de-facto complainant. It is alleged that the petitioner and others abused filthy language, due to which, the petitioner and others assaulted the de-facto complainant with hands and woodenlog, resulting in, the de-facto complainant sustained grievous injuries. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution and the petitioner is also ready to co-operate with the investigation. Hence, he prays to grant bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that though the injured has been discharged from the hospital, the petitioner is having six previous cases, and if anticipatory bail is granted to the petitioner, there is a likelyhood of indulgence in similar activities in the future. He opposed to grant anticipatory bail to the petitioner.

5. Considering the fact that the gravity of offence committed by the petitioner; that the petitioner is having six previous cases similar in nature and if anticipatory bail is granted to the petitioner, he would indulge in similar activities in the future, this Court is not inclined to grant anticipatory bail to the petitioner.
