ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 351(2), 316(2) and 318 (4) of BNS in Crime No.260 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner collected a sum of Rs.4,86,000/- by way of conducting chit fund and subsequently, he did not repay the amount. Hence the complaint has been lodged.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He also submitted that the petitioner is not cheated the de-facto complainant and it is only a loan transaction. He further submitted that she is ready to abide by any conditions that may be imposed by this Court and sought for anticipatory bail to the petitioner and she is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent reiterated the prosecution case and reported that the petitioner conducted an unregistered chit fund and collected a sum of Rs.4,86,000/- and he did not repay the same. He further submitted that the investigation is pending. He opposed to grant anticipatory bail to the petitioner.

5. Considering the huge amount involved in this case; no amount has been recovered so far; that the investigation is pending and if anticipatory bail is granted to the petitioner, he would indulge similar activities in the future, I am not inclined to grant anticipatory bail to the petitioner.

6.Accordingly, this Criminal Original Petition is dismissed. 03.12.2025 MSM
