Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to pay the petitioner monthly pension treating his basic pay as Rs.66,250/- and also accordingly to pay the terminal benefits namely commuted value of pension, gratuity, PF earned leave encashment benefit and other benefits within a period as fixed by this Honorable Court along with 12 % interest for the belated payment. ORDER

This Writ Petition has been filed seeking a direction to the respondents to pay the petitioner's monthly pension treating his basic pay as Rs.66,250/- and also to pay the terminal benefits such as commuted value of pension, gratuity, provident fund and other benefits, together with interest at the rate of 12% per annum for the belated payment.

2.Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the first respondent. Perused the materials available on record.

3.Without expressing any opinion on the merits of the writ petition, the respondents are directed to consider the representation submitted by the petitioner and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. 4.With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
